During the last hard rain, streets and structures were flooded where once existed drainage that helped prevent flooding.
Some streets have ditches or easements to drain water. Some ditches or easements have been filled with landscaping material such as decorative rocks, berms, soil or other elements that hamper or change the flow of water and divert water into neighboring property or onto streets by obstructing or filling what had been a functional drainage system.
Some residents have built berms, walls or other structures on their property that divert water that normally would naturally flow onto their property, onto other resident properties.
WPOA cautions property owners about the described practices. Improperly filling easements with rocks or building berms may divert water and damage streets or property.
Texas Water Code 11.086 – Overflow Caused by Diversion of Water
(a) No person may divert or impound the natural flow of surface waters in this state, or permit a diversion or impounding by him to continue, in a manner that damages the property of another by the overflow of the water diverted or impounded..
